(“Pendulum”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the website (“Site”) and the underlying Pendulum service. Personal Information we collect stays with Pendulum and its trusted partners. Personal Information or Personal Data refers to any information relating to an identified or identifiable natural person.  We collect Personal Information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Pendulum may collect and use Users’ Personal Information for the following purposes:

Pendulum Partners:  We work with third parties who provide consulting, sales and technical services to deliver and implement customer solutions around the Services.  We may share your information with these third parties in connection with their services.

Compliance with Enforcement Requests and Applicable laws:  In exceptional circumstances, we may share information about you with a third party if we believe that sharing is reasonably necessary to (a) comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements; (b) enforce our agreements, policies and terms of service; (c) protect the security or integrity of our products and services; (d) protect Pendulum, our customers or the public from harm or illegal activities, or (e) respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of nay person.

Pendulum acknowledges that you have the right to access your Personal Information. Pendulum has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to Pendulum’s Client (the data controller). If the Client requests Pendulum to remove the data, we will respond to their request within a reasonable timeframe.
